The personal toll of separation and divorce is trying enough; unintended tax consequences can make the situation even worse. I have years of experience dealing with these matters, including often-overlooked areas such as capitalized litigation costs and "non-QDRO QDROs."
Invariably, issues arise as to the final marital tax return (Joint or Separate?), who gets the state tax refund, who gets to claim the dependents and itemized deductions, etc. It is critical that these matters be addressed in the separation agreement and/or property settlement.
